Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you ("User") and Thungong Chaitaychawantanapon ("we", "us") governing your use of Mail Intelligence, available at mail.thatwhy.me ("Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Mail Intelligence is an AI-powered email intelligence platform that connects to your Gmail inbox (with your explicit authorisation) to extract structured insights, surface actionable information, and assist with email composition. The Service is intended for individual and business productivity use.
3. Account Registration
To use the Service, you must sign in with a valid Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorised use of your account.
4. Gmail Access and OAuth
By connecting your Gmail account, you grant Mail Intelligence read access to your emails for the purpose of extracting structured intelligence. You may revoke this access at any time from your Google Account permissions page or from within the Mail Intelligence dashboard. Revoking access stops all future syncing; previously extracted data will be deleted within 7 days upon request.
You must only connect Gmail accounts that you own or have lawful authority to access. Connecting accounts belonging to others without their explicit consent is prohibited.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Access email accounts you do not own or are not authorised to access.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use automated tools to scrape, overload, or abuse the Service's APIs beyond normal usage.
- Transmit harmful, harassing, defamatory, or fraudulent content through the Service.
- Resell or sublicense access to the Service without prior written consent from Thungong Chaitaychawantanapon.
6. Intellectual Property
The Service, including its software, design, trademarks, and content (excluding your own email data), is owned by Thungong Chaitaychawantanapon and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for its intended purpose. Nothing in these Terms transfers ownership of any intellectual property to you.
Your email content and any data derived from it remain your property. We claim no ownership over your emails or extracted data.
7. Data and Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described therein.
8. Service Availability
We aim to provide a reliable, high-availability service but do not guarantee uninterrupted access. We may perform scheduled maintenance, and we will endeavour to give advance notice of significant downtime where possible. We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice.
9. Fees and Payment
The Service is currently provided free of charge during its early access period. Should paid plans be introduced in the future, we will give existing users at least 30 days' notice before any charges apply, and you will have the opportunity to discontinue use before being charged.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or that AI-generated insights will be accurate or complete. You rely on AI-generated output at your own discretion.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Thungong Chaitaychawantanapon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim, or USD 100 if you have not made any payments.
12. Indemnification
You agree to indemnify and hold harmless Thungong Chaitaychawantanapon and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
You may terminate your account at any time by deleting it from the dashboard. We may suspend or terminate your access if you breach these Terms, with or without notice depending on the severity of the breach. Upon termination, your right to use the Service ceases immediately and we will delete your data in accordance with our Privacy Policy.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of Thailand. Any disputes will be resolved in good faith between the parties.
